Suggestions invited for Overseas Mobility (Facilitation and Welfare) Bill, 2025

Government of India has proposed Overseas Mobility (Facilitation and Welfare) Bill, 2025 which seeks to replace the Emigration Act, 1983 in response to the changing nature of international mobility and the growing global presence of Indian citizens. The 1983 Act, designed primarily to regulate low-skilled labour emigration, no longer reflects the diverse profiles of Indians moving abroad who today, include students, professionals, and entrepreneurs.

This Bill moves beyond a regulatory approach and focuses on enabling safe, transparent, and seamless mobility for Indian citizens while ensuring their welfare and protection abroad.

The Salient features of the proposed Overseas Mobility (Facilitation and Welfare) Bill, 2025 are as follows:

(i) It proposes to establish an Overseas Mobility and Welfare Council that aims to provide greater convergence between Ministries with respect to policy management.

(ii) The Bill seeks to strike a balance between promoting opportunities abroad and establishing a regulatory framework for protection and welfare of vulnerable categories.

(iii) The Bill creates a mechanism to oversee administration and implementation of international agreements on migration and mobility.

(iv) It creates robust data driven policy management based on labour studies and coordinated actions with different ministries and departments.

In line with the true participatory spirit, the Government of India seeks views from all its nationals in India and overseas on the draft bill.
